1. GENERAL

By accessing or using the Website, you agree to be bound by these Terms and Conditions (“T&Cs”), which apply to all transactions made online through the Website. To use or shop at the Website, you must be a registered user and agree to these T&Cs.
The Gallery offers a range of services, and additional terms may apply to specific services. In the event of any inconsistency between these T&Cs and specific service terms, the latter will take precedence.

2. PRODUCT INFORMATION
The Gallery features art pieces that are carefully curated for sale on the Website. Once an item is sold out, it will be removed from the Website. Product prices may fluctuate over time.
The Gallery is not the creator of the products sold but strives to ensure that product descriptions and images are accurate. Actual packaging and materials may differ from the Website's representation.
3. ORDER
By placing an order through the Website, you confirm that you are of legal age and have the capacity to enter into a binding agreement. Any false or inaccurate information provided may result in the termination of the agreement without compensation.
Orders are subject to acceptance based on the availability of products, authorization of payment, and other factors. An acknowledgment email will be sent upon placing an order, but this does not constitute acceptance. Acceptance occurs when the item is dispatched, and you will receive a dispatch confirmation with tracking details. Orders are dispatched only after full payment is received.
The Gallery strives for accuracy in product details but cannot guarantee that images will represent the actual merchandise due to variances in monitor settings and equipment.
4. DELIVERY
Delivery is handled through reputable courier services, with standard delivery times applicable. Delivery charges are the responsibility of the buyer and will be quoted by the courier.
Delivery times may be extended during busy periods. The Gallery is not liable for delays or failures in delivery and any issues should be addressed directly with the courier. Risk of loss and damage passes to the buyer upon dispatch.
5. PRICING AND AVAILABILITY
All prices are inclusive of applicable taxes. Additional customs or import duties are the responsibility of the buyer. Prices are correct at the time of listing but may change. The Gallery will notify buyers of any pricing errors and offer the option to reconfirm or cancel orders. Availability is subject to change, and buyers will be informed if items become unavailable.
6. ROLE OF ART GALLERY
As Seller: The Gallery sells products from its own inventory and is responsible for the sale of these items.
As Facilitator: The Gallery also facilitates the sale of products from third-party sellers. The contract of sale for these items is between the buyer and the third party, with the Gallery not assuming responsibility for any issues arising from these transactions.
7. LIABILITY AND INDEMNITY
The Gallery will make efforts to ensure service availability but cannot guarantee uninterrupted access. The Gallery is not liable for any direct, indirect, or consequential damages arising from the use of the Website or purchase of products. Liability for delays or non-performance due to force majeure events is also disclaimed. Buyers agree to indemnify the Gallery against any claims arising from breaches of these T&Cs.
8. PAYMENT
Payments up to [currency limit] will be accepted by credit card. For amounts exceeding this, bank transfer instructions will be provided. The Gallery takes reasonable measures to protect payment details but is not liable for unauthorized access by third parties. The Gallery will process payments in the local currency or the equivalent value.
9. GUARANTEE FOR GENUINENESS AND AUTHENTICITY
The Gallery guarantees the authenticity of its own inventory. For items sold by third-party sellers, authenticity guarantees are the responsibility of the individual seller. Disputes regarding authenticity must be resolved directly between the buyer and the seller.
10. GIFT CARDS

⦁ They can be purchased online using various payment methods.
⦁ Available in fixed denominations or custom amounts.
⦁ Each card features a unique code for online redemption.
⦁ They can be used for partial payments but not redeemed for cash.
⦁ Responsibility for lost or stolen cards lies with the purchaser/recipient.
⦁ Usable with other promotions.
⦁ Not exchangeable for cash.
11. RETURNS
Due to the nature of the products sold, returns are not accepted.
12. MEMBER ACCOUNTS & PRIVACY
Users must maintain the confidentiality of their account and password. The Gallery is not liable for unauthorized use of accounts. Users must notify the Gallery of any security breaches and ensure they log out of shared computers.
13. INTELLECTUAL PROPERTY, COMMENTS, AND REVIEWS
The Website's content is the intellectual property of the Gallery. Users may not use or reproduce content without permission. Comments and reviews should be respectful and not infringe on others’ rights.
14. WAIVER
Failure to enforce any provision of these T&Cs does not constitute a waiver of that provision.
